1. Acceptance of terms
By accessing or using ValTrak (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use the Service.
2. Description of the service
ValTrak is a subscription tool that lets you record, organise and value personal or business property, keep maintenance records, and store insurance details. ValTrak is a record-keeping aid only. It is not an appraisal service, an insurance product, or professional financial advice.
3. Accounts and eligibility
You must be at least 18 years old and provide accurate registration information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use.
4. Subscription, billing and renewal
Access to ValTrak is offered on an annual subscription of $19.99 per year. Subscriptions renew automatically at the then-current rate unless cancelled before the renewal date. You may request a full refund within seven days of any subscription payment, including a renewal, through our Contact us page. Include the email used for your account and the payment date; do not send your card details. After seven days, refunds are available where required by law. Cancelling automatic renewal does not itself submit a refund request. We may change pricing with reasonable prior notice, effective at your next renewal.
5. Your content
You retain ownership of all information, photographs and records you upload. You grant ValTrak a limited licence to store, process and display that content solely to operate the Service for you. You represent that you have the right to upload the content you submit.
6. Acceptable use
You agree not to misuse the Service, including by uploading unlawful or infringing material, attempting to gain unauthorised access to other accounts or systems, reverse engineering the Service, or using it to store data you are not permitted to hold.
7. Valuations and estimates
Value estimates, including any automatically suggested values derived from uploaded photographs, are approximations provided for convenience. They are not appraisals and must not be relied upon for insurance, tax, legal or resale purposes. You are responsible for verifying all values with a qualified professional.
8. Shared links
If you generate a shareable link, anyone holding that link may view the information you have chosen to share. You are responsible for who you send it to and may revoke or regenerate the link at any time.
9. Privacy and data
We do not sell your information. We collect and process information needed to provide the Service, including account details and the records you enter. See our Privacy statement for details, including connected services.
10. Availability
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates or circumstances beyond our reasonable control.
11. Termination
You may cancel your subscription at any time; access continues until the end of the paid period. We may suspend or terminate accounts that breach these terms. On termination we may delete your data after a reasonable retention period.
12. Disclaimer and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, ValTrak shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or property. Our total aggregate liability shall not exceed the amount you paid in the twelve months preceding the claim.
13. Indemnity
You agree to indemnify and hold harmless ValTrak and its officers, employees and agents from any claim arising out of your use of the Service or your breach of these terms.
14. Intellectual property
The ValTrak name, logo, software and design are owned by ValTrak and protected by applicable intellectual property laws. No licence is granted except the limited right to use the Service.
15. Changes to these terms
We may update these terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
16. Governing law and contact
These terms are governed by the laws of the jurisdiction in which ValTrak is established, without regard to conflict of law principles. Questions about these terms can be sent through the Contact page.
